Growth & Search is a human-governed Strategic Operating System designed to help
established businesses understand their operating position, identify what matters,
establish clearer priorities and take more focused action.
✓ The Annual Business Licence currently runs for 12 months and does not automatically renew.
✓ Platform outputs support decision-making but do not replace professional advice.
✓ AI may assist analysis, guidance and reporting, but business leaders remain responsible for decisions.

Welcome to Growth & Search.
These Terms & Conditions govern access to and use of the Growth & Search
website, Strategic Operating System, assessments, operating tools, reports,
AI-assisted functionality, content and related services.
By accessing or using the Platform, completing a Strategic Clarity &
Readiness Check, activating an Annual Business Licence, requesting a Strategic
Operating Review or otherwise using Growth & Search, you agree to these Terms
& Conditions.
If you do not agree with these Terms, you should not use the Platform.
Growth & Search is operated from Australia and is initially offered to
businesses in Australia and the United Kingdom.
Growth & Search is a human-governed Strategic Operating System designed to
help established businesses:
The Platform provides assessments, operating-practice guidance, strategic
observations, priority actions, AI-assisted guidance and optional reporting.
Growth & Search does not replace professional legal, accounting, financial,
taxation, employment, investment or other regulated professional advice.
Technology supports the process. Business owners and leadership teams remain
responsible for their decisions and actions.
A 12-month licence providing an eligible business with access to the Growth
& Search Strategic Operating System, subject to these Terms.
The business or legal entity holding an active Annual Business Licence.
The Growth & Search website, Strategic Operating System, assessments,
operating tools, AI-assisted functionality, reports, content, software and
associated services.
The Growth & Search operating methodology and Platform through which
businesses assess their position, review operating practices, establish
priorities and manage ongoing improvement.
Growth’s Magnificent Seven® is the registered Growth & Search framework
around which the principal operating areas of the Strategic Operating System
are structured.
The complimentary introductory assessment offered by Growth & Search.
The assessment functionality used within the Strategic Operating System to
help a business evaluate its current operating position.
The review functionality through which businesses consider relevant operating
practices and their current status.
The AI-assisted decision-support and guidance functionality available through
the Platform.
The optional fixed-price review available to eligible Annual Business Licence
holders, subject to the relevant completion prerequisites.
Growth & Search is designed primarily for business use.
A person creating an account or activating a licence on behalf of a business
confirms that they have authority to act for that business and to accept these
Terms on its behalf.
One Annual Business Licence applies to one business or legal entity unless
Growth & Search agrees otherwise in writing.
Upon payment of the applicable licence fee, Growth & Search grants the
Licensee a limited, non-exclusive, non-transferable and revocable right to
access and use the Strategic Operating System for the Licensee’s internal
business purposes during the applicable licence period.
The licence does not transfer ownership of Growth & Search intellectual
property.
The licence may not be sublicensed, resold, assigned, shared with another
business or transferred without written approval from Growth & Search.
Authorised personnel within the licensed business may participate in the
business’s use of the Platform where appropriate.
Unless otherwise stated at the time of purchase, an Annual Business Licence
provides access for 12 months from activation.
The Annual Business Licence does not currently renew automatically.
At the end of the licence period, the Licensee may be invited to renew access
for a further period at the price and on the terms then applying.
If the licence is not renewed, access to paid Platform functionality may end
or become restricted at expiry.
Growth & Search may introduce different renewal arrangements in the future.
Any change applying to an existing customer will be clearly disclosed before
that customer becomes subject to the new arrangement.
Licence fees and prices for optional services are displayed on the Growth
& Search website or at checkout.
Fees are payable in advance unless otherwise stated.
Unless expressly stated otherwise, Australian prices are exclusive of GST.
Growth & Search may change pricing for future purchases or renewal periods.
A pricing change does not retrospectively alter an amount already paid for an
existing licence period.
Payments may be processed through third-party payment providers such as Stripe.
A Licensee may choose not to continue using the Platform at any time.
Because the Annual Business Licence provides access for a fixed licence period,
cancellation by the Licensee does not automatically entitle the Licensee to a
full or pro-rata refund for unused time.
Refunds will be provided where required by applicable law or where Growth
& Search otherwise agrees that a refund is appropriate.
Nothing in these Terms excludes, restricts or modifies rights or remedies that
cannot lawfully be excluded.
Growth & Search may provide selected businesses with complimentary, trial,
validation, promotional, coupon-based or discounted access.
Such access remains subject to these Terms.
Growth & Search may determine the duration, scope and functionality of
complimentary or validation access and may end or modify that access on
reasonable notice.
Complimentary or promotional access does not create an entitlement to ongoing
free access or future discounts.
Feedback provided during validation or testing may be used by Growth &
Search to improve the Platform, provided that personal and confidential
business information is handled in accordance with the Privacy Policy.
The Strategic Clarity & Readiness Check is a complimentary introductory
assessment designed to help businesses consider their current strategic
clarity and operating readiness.
Results are generated from information supplied by the user and are indicative
only.
They are intended to help identify areas that may deserve greater attention and
should not be relied upon as professional advice or as a guarantee of business
performance.
An active Annual Business Licence may provide access to functionality including:
Growth & Search may improve, update, replace or reorganise Platform features
as the service develops.
Where a change materially reduces core paid functionality during an active
licence period, Growth & Search will seek to provide reasonable notice where
practicable.
The Strategic Operating Review is an optional separate service available to
eligible Annual Business Licence holders.
The applicable fee is the amount displayed on the Platform at the time the
service is requested.
To support a meaningful review, the business must ordinarily have completed
at least:
Growth & Search may decline or defer preparation of a Strategic Operating
Review where the information available is insufficient to produce a useful
review.
The Strategic Operating Review may incorporate:
The review may identify leadership observations, priority areas and
Now / Next / Later actions.
The Strategic Operating Review is intended as decision support. It is not
professional advice and does not guarantee any particular business, financial
or commercial outcome.
Growth & Search uses artificial intelligence, including the OpenAI API, as
an enablement layer within parts of the Platform.
AI may assist with:
AI-generated information may contain errors, omissions, assumptions or
information that is not suitable for a particular business situation.
Users must independently evaluate material outputs before relying upon or
acting on them.
Growth & Search does not warrant that AI-generated outputs will always be
accurate, complete, current or appropriate.
Growth & Search is designed as a
human-governed Strategic Operating System.
Final judgement, decisions and implementation remain the responsibility of
the business owner or leadership team.
Growth & Search does not currently use automated processing to make
decisions about individuals that produce legal or similarly significant
effects.
Information processed through AI functionality is also handled in accordance
with the Growth & Search Privacy Policy.
Growth & Search may provide functionality designed to help a business
translate an identified priority or initiative into a clearer implementation
or provider-search brief.
Growth & Search does not, unless expressly stated otherwise:
Businesses remain responsible for undertaking their own enquiries, due
diligence, selection and contracting when obtaining external implementation
support.
Any engagement with an independent provider is between the business and that
provider.
The Licensee retains ownership of information and materials it submits to the
Platform.
The Licensee grants Growth & Search the rights reasonably necessary to
host, process, analyse and use that information to:
These activities are undertaken in accordance with these Terms and the Growth
& Search Privacy Policy.
Growth & Search does not acquire ownership of the Licensee’s underlying
business information merely because that information is submitted to the
Platform.
Users are responsible for:
Users should not submit information that is unnecessary for the relevant
Growth & Search function.
In particular, users must not knowingly submit:
Except for information owned by Licensees or third parties, intellectual
property associated with Growth & Search remains owned by or licensed to
Risk Management Recruiters Pty Ltd.
This includes, where applicable:
The Annual Business Licence grants permission to use the Platform for the
Licensee’s own internal business purposes. It does not transfer ownership of
that intellectual property.
Businesses may use their own assessment results, priority actions, reports
and other outputs internally for operating and implementing their business.
Users must not:
A Licensee must not use Growth’s Magnificent Seven®, Growth & Search
assessment architecture, proprietary operating-practice structures, prompts,
scoring methods, prioritisation frameworks, report structures or other
proprietary methodology to create, train, develop or commercialise a
substantially competing product, software platform, framework or advisory
system.
This provision does not prevent a business from applying Growth & Search
outputs and recommendations internally to improve its own operations.
Growth & Search provides business information, structured assessment and
decision-support functionality.
Nothing within the Platform constitutes professional:
Users should obtain independent specialist advice where a matter requires
professional judgement or regulated expertise.
Growth & Search relies on internet infrastructure and selected third-party
technology providers.
These may include hosting, payment, email, analytics, artificial intelligence
and other technology services.
Growth & Search does not guarantee that the Platform will always operate
without interruption, delay, technical error or third-party service disruption.
Access may occasionally be limited or suspended for:
Growth & Search will seek to restore affected services within a reasonable
period where practicable.
Use of Growth & Search is subject to the Growth & Search Privacy Policy.
The Privacy Policy explains how personal and business information may be
collected, used, processed, disclosed, retained and protected, including where
third-party technology and AI services are involved.
Users should review the Privacy Policy together with these Terms.
Growth & Search may suspend or terminate access where reasonably necessary,
including where:
Where appropriate and reasonably practicable, Growth & Search may provide an
opportunity to remedy a breach before terminating paid access.
Termination or expiry does not affect rights or obligations that accrued before
termination.
Provisions relating to intellectual property, confidentiality, liability and
other provisions intended to survive termination continue to apply.
Growth & Search seeks to provide the Platform with reasonable care and skill.
However, business conditions, markets, technology and individual circumstances
vary, and Growth & Search does not guarantee:
To the maximum extent permitted by law, Growth & Search is not responsible
for indirect or consequential loss arising from use of the Platform, including
loss of profit, revenue, opportunity or anticipated savings, except to the
extent such liability cannot lawfully be excluded or limited.
Where liability can lawfully be limited, Growth & Search’s aggregate
liability arising from the relevant service will ordinarily be limited to the
fees paid by the affected Licensee to Growth & Search for that service during
the preceding 12 months.
This limitation does not apply where it would be unlawful or unreasonable to
rely upon it.
Nothing in these Terms excludes, restricts or modifies any guarantee, right,
condition, warranty or remedy that cannot lawfully be excluded or restricted,
including applicable rights under the Australian Consumer Law
and applicable mandatory laws in the United Kingdom.
Growth & Search will not be responsible for a failure or delay caused by
circumstances outside its reasonable control, including major internet
outages, infrastructure failures, third-party service disruptions, cyber
incidents, natural disasters, government action or similar events.
Where such an event occurs, Growth & Search will take reasonable steps to
restore or resume affected services where practicable.
Growth & Search is an evolving service.
We may introduce, modify, reorganise, improve or discontinue particular
Platform features as technology, user requirements and the operating model
develop.
Changes may also be required because of legal, security, technical or
third-party-provider requirements.
Growth & Search will not use this provision to retrospectively remove rights
that cannot lawfully be removed.
Where practicable, reasonable notice will be provided if a change materially
affects core functionality available under an active paid licence.
Growth & Search may update these Terms from time to time to reflect changes
in:
The current version will be published on the Growth & Search website with
its effective date.
Where a change is material and affects an existing Licensee, Growth &
Search will take reasonable steps to notify the Licensee where appropriate.
Changes will not retrospectively remove rights that have already accrued or
rights that cannot lawfully be excluded.
These Terms are governed by the laws of
South Australia and the Commonwealth of Australia.
The parties submit to the jurisdiction of the courts of South Australia,
subject to any applicable rights, protections or jurisdictional requirements
that cannot lawfully be excluded.
Nothing in these Terms is intended to remove mandatory legal rights that may
apply to a user in the United Kingdom or another jurisdiction in which Growth
& Search lawfully provides its services.
If any provision of these Terms is found to be invalid or unenforceable, the
remaining provisions continue to apply to the extent permitted by law.
A failure by Growth & Search to enforce a provision immediately does not
constitute a waiver of that provision.
These Terms, together with the Privacy Policy and any specific terms displayed
when purchasing a Growth & Search service, form the agreement governing use
of the Platform.
If specific written terms for a particular Growth & Search service conflict
with these general Terms, the specific terms will apply to that service to the
extent of the inconsistency.
