Welcome to Growth & Search.
These Terms & Conditions govern access to and use of the Growth & Search Strategic Operating System™, related assessments, reports, tools, content, software functionality, AI-assisted features and associated services.
By accessing or using the Platform, completing a Strategic Clarity & Readiness Check, purchasing an Annual Business Licence, requesting a Strategic Operating Review Report or otherwise using the Platform, you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms, you must not use the Platform.
Growth & Search is a human-governed Strategic Operating System™ designed to help businesses improve strategic clarity, prioritisation, operating discipline and execution.
The Platform provides educational information, assessments, benchmarking tools and strategic guidance.
Growth & Search does not provide legal, accounting, financial, investment, employment, tax, engineering, medical or other regulated professional advice.
All decisions remain the responsibility of the business owner and leadership team.
The annual licence granting authorised access to the Growth & Search Strategic Operating System™.
The individual or legal business entity holding an active Annual Business Licence.
The Growth & Search website, software functionality, assessments, AI-assisted systems, reports, tools, content and related intellectual property.
The proprietary Growth & Search methodology, operating framework, Growth’s Magnificent Seven™ model, assessment architecture, benchmarking systems, reporting structures, operating guidance and associated intellectual property.
The complimentary introductory assessment provided by Growth & Search.
The optional fixed-price report service available to eligible Annual Business Licence holders.
The AI-assisted guidance tool available within the Platform.
Upon payment of the applicable Annual Business Licence Fee, Growth & Search grants the Licensee a limited, non-exclusive, non-transferable, revocable licence to access and use the Strategic Operating System™ for internal business purposes.
The licence does not transfer ownership of any intellectual property.
The licence may not be sublicensed, resold, assigned or transferred without written approval from Growth & Search.
One Annual Business Licence applies to one legal business entity unless otherwise agreed in writing.
Licence fees are payable in advance.
Licence fees provide access to the Strategic Operating System™ for the applicable licence period.
Growth & Search may change future licence pricing at its discretion.
Unless otherwise stated, all fees are exclusive of GST.
Failure to maintain an active licence may result in suspension or termination of access.
The Strategic Clarity & Readiness Check is provided for educational and informational purposes only.
Results are generated from user responses and should not be relied upon as professional advice.
Growth & Search makes no guarantee regarding business outcomes arising from use of the assessment.
An active Annual Business Licence may provide access to:
Growth & Search reserves the right to modify Platform features without notice.
The Strategic Operating Review Report is an optional fixed-price service available to eligible Annual Business Licence holders.
Growth & Search may require minimum completion thresholds before a report is generated.
Current guidance may include completion of approximately 70% of diagnostic questionnaires and benchmarking reviews.

All implementation decisions remain the responsibility of the Licensee.
The Operating System Assistant is designed to provide contextual guidance within the Growth & Search Strategic Operating System™.
Responses generated by the assistant:
Growth & Search does not warrant the accuracy, completeness or suitability of AI-generated outputs.
All intellectual property remains the property of Growth & Search unless otherwise stated.
This includes but is not limited to:
No rights are transferred except those expressly granted under the licence.
Users must not:
The Licensee must not use the Strategic Operating System™, Growth’s Magnificent Seven™, assessment structures, benchmarking methodologies, prioritisation frameworks or related intellectual property to create, develop, train, improve or commercialise competing products, services, frameworks, software platforms or advisory offerings.
Growth & Search may use artificial intelligence technologies to assist in generating:
AI-generated content is intended to support decision-making and should not replace professional judgement.
Growth & Search does not warrant that AI-generated outputs will be complete, accurate, current or suitable for any particular purpose.
Growth & Search provides educational information only.
Nothing within the Platform constitutes:
Users should obtain independent professional advice appropriate to their circumstances.
Users are responsible for:
Growth & Search is not responsible for decisions made by users.
To the maximum extent permitted by law:
Growth & Search excludes all warranties not expressly stated.
Growth & Search shall not be liable for:
Total liability shall not exceed the fees paid by the user during the preceding twelve months.
Nothing in these Terms excludes rights under Australian Consumer Law.
Use of the Platform is also governed by the Growth & Search Privacy Policy.
Users consent to the collection, storage and processing of information necessary to provide Platform services.
Growth & Search may suspend or terminate access where:
Termination does not affect accrued rights or obligations.
Growth & Search may update these Terms & Conditions from time to time.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
These Terms are governed by the laws of South Australia and the Commonwealth of Australia.
Any disputes shall be subject to the exclusive jurisdiction of Australian courts.
