Terms & Conditions Of Use

1. Definitions

“We,” “Us,” “Our” means Risk Management Recruiters Pty Ltd (ABN 23 089 022 999) trading as Growth & Search™.

“Platform” means the Growth & Search website, web application, diagnostics, reports, frameworks, AI tools, Concierge Search services and related materials.

“You” means any individual or organisation using the Platform.

“Content” includes all frameworks, methodologies, benchmarks, scoring logic, workflows, reports, prompts, tools and related materials.

“Growth’s Magnificent Seven™” is our registered trademark and proprietary operating framework.

“Growth Priority Review” means any prioritised roadmap, benchmarking insight or strategic output generated through the Platform.

2. Nature Of The Platform

Growth & Search is a self-managing strategic growth operating system.

The Platform provides:

• Frameworks and methodologies
• Structured diagnostics and assessments
• Best-practice-informed benchmarking
• Prioritisation and operational insight tools
• AI-assisted support functionality
• Concierge Search and provider discovery support

The Platform does not provide ongoing consulting, execution services or professional advisory services unless expressly agreed separately in writing.

3. Use Of The Platform

You must:

• Be at least 18 years of age
• Use the Platform for lawful business purposes
• Provide reasonably accurate information where required

You must not:

• Copy, reproduce or commercially exploit Platform Content
• Reverse-engineer system logic, scoring or methodologies
• Use outputs to develop competing products or services
• Share access credentials outside your business without permission

4. Intellectual Property

All Content remains the property of Growth & Search and is protected under applicable intellectual property laws.

This includes:

• Growth’s Magnificent Seven™
• Frameworks and methodologies
• Assessment structures and benchmarks
• Scoring logic and prioritisation systems
• Reports, prompts, workflows and system architecture

You are granted a limited, non-transferable licence for internal business use only.

5. Benchmarking, Scoring & System Outputs

The Platform generates operational insights using:

• User-provided inputs
• Best-practice-informed reference models
• Proprietary interpretation and prioritisation logic
• AI-assisted analytical processes

You acknowledge that:

• Outputs are indicative only
• Outputs are not certified rankings or guarantees
• Methodologies may evolve over time
• You receive insights, not underlying system mechanics

6. Use Of AI

Growth & Search may use AI technologies, including OpenAI tools, to support:

• Structured analysis
• Content refinement
• Report generation
• Operational insights
• Concierge Search processes

AI is used as an operational enablement layer only. Leadership judgement and decision-making responsibility remain with the user.

AI-generated outputs may not always be complete, accurate or appropriate for every circumstance.

7. Full System Access & Services

Full System Access provides access to:

• Growth’s Magnificent Seven™ framework
• Diagnostics and benchmarking tools
• AI-assisted Growth Mentor functionality
• Prioritisation and reassessment tools
• Concierge Search access
• Growth Priority Review eligibility

Access does not include implementation services, outsourced execution or professional advisory engagement unless separately agreed.

Concierge Search

Concierge Search is an AI-assisted, human-governed provider discovery service designed to help users identify suitable third-party providers, technologies or specialists.

For straightforward projects under AUD $10,000, recommendations may be provided automatically at no additional cost.

Larger or more complex projects may require separately scoped support arrangements.

Growth Priority Review

The Growth Priority Review is a separate fixed-price roadmap service that converts assessment and benchmarking inputs into prioritised operational outputs.

Users may be required to complete sufficient assessment and checklist inputs before reports are produced.

8. Third-Party Providers

Growth & Search may introduce users to independent providers through Concierge Search or related platform functionality.

We do not control or deliver third-party services and do not guarantee provider outcomes, quality or performance.

Engagement decisions remain solely between the user and the third-party provider.

9. No Professional Advice

All Platform Content is general information only and is educational and operational in nature.

Growth & Search does not provide legal, financial, accounting or professional advice.

Independent professional advice should be obtained before making significant business decisions.

10. User Responsibility

You remain solely responsible for:

• Business decisions and actions
• Accuracy of submitted information
• Implementation and execution outcomes
• Use of any third-party providers

Growth outcomes depend on many factors beyond our control.

11. Limitation Of Liability

To the maximum extent permitted by law, Growth & Search is not liable for:

• Business losses or operational disruption
• Decisions made using Platform outputs
• Third-party provider outcomes
• Reliance on AI-generated insights

The Platform and all services are provided “as is.”

12. Privacy

Use of the Platform is subject to our Privacy Policy.

13. Changes To Terms

We may update these Terms periodically to reflect operational, legal or platform changes.

Continued use of the Platform may constitute acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of South Australia, Australia.
